Hiring a Buyer’s Agent
or Exclusive Buyer Agency

Most agents don’t explain how RealtorsŪ work together to sell properties. Sellers hire a Listing Agent (the company with the sign in the yard) to sell their home and agree to pay a commission, which in our area can run from 4-6% of the sales price of the home.

Once listed the home goes into the MLS (Multiple Listing Service) and all the MLS Member agents in an area access this total inventory of homes. The MLS information discloses how much commission the Seller is willing to pay to help sell the home. Since the Sellers have already agreed to pay the commission it does not cost you, the Buyer, any more or any less to use a Buyer’s Agent to purchase a home.

I started using a “Buyer’s Agency Form” due to feeling a conflict of interest. I would learn something about the home or the Seller’s situation that would be to my Buyer’s advantage and I wanted to know exactly whom I was representing.

As a Buyer's Agent I don't need to sell you on a particular property, but simply give you the support and information you need to make your own informed choice. Because we are under contract I know that you will eventually purchase through me. Conversely, a Seller’s agent knows that if they don't sell you a house today you may buy one from another agent tomorrow. So the pressure is on.

To eliminate this pressure and conflict of interest, I will, as your Buyer's Agent:

  • Provide you with an initial counseling session.
  • Be consultative and counseling-oriented in my approach.
  • Always stay loyal to the YOU, the Buyer, and YOUR best interests.
  • Help you to interpret all information presented.
  • Investigate the neighborhood, the seller's motives and additional pertinent information to assist the YOU in negotiations.
  • Show all homes that fit the YOUR needs. Including homes from the Multiple Listing Service, For Sale by Owner, Bank Owned, and homes not on the market.
  • Research a property's true market value
  • Inform YOU of a home's weaknesses and strengths.
  • Develop a specific personal negotiating strategy
  • Negotiate to get the lowest price and best terms for YOU.
  • Keep all YOUR information, financial status and negotiating strategies confidential.

One of the advantages of Buyer Agency is the freedom I have as the Buyer's Agent to approach the purchase as though I were buying for myself.

As a Buyer's Agent it's a matter of applying my skills, experience, and expertise in a professional manner for the benefit of the Buyer-client. Yes, this places a lot more responsibility and liability on my shoulders, but it is wonderfully refreshing to work with personal integrity.

Now that you are aware I encourage you to interview an RealtorŪ who is willing to use an Exclusive Buyer’s Agency Agreement. Ask the right questions, for example:

  • How much experience have they had with Buyer Agency?
  • How many buyer-clients have they represented?
  • Do they use a written Buyer Agency contract? (You should insist on it)
  • May you review it?
  • What happens if you decide to buy one of their listings?
  • If you are dissatisfied, can you terminate your agency relationship?
  • How many homes are they prepared to show you?
  • How long does it typically take to find a buyer a home?
  • What is their approach and involvement in the home inspection?
  • Can you talk to any of their past clients and get references?
